Terms of Use

These Terms explain the rules for using PresenceOS, including the website, iOS app, AI-assisted content tools, subscriptions, and optional post-boost services.

Agreement to these Terms

These Terms of Use are an agreement between you and the operator of PresenceOS. PresenceOS is presented as a product from Pixis. If the contracting entity is different, replace this sentence with the correct legal entity name, registered address, and company details before publication.

By accessing the PresenceOS website, downloading the app, creating an account, purchasing a subscription, using AI-generated content features, or using a post-boost service, you agree to these Terms. If you do not agree, do not use PresenceOS.

Who may use PresenceOS

You must be legally able to enter into a binding agreement in your jurisdiction. If you use PresenceOS on behalf of a company, team, or other organization, you confirm that you have authority to bind that organization to these Terms.

PresenceOS is not intended for children. You may not use PresenceOS if you are under the age required to consent to online services in your jurisdiction.

What PresenceOS does

PresenceOS helps users create, improve, organize, and engage with professional social content. Features may include voice-to-post workflows, AI-assisted post drafts, AI-generated images, contextual comment suggestions, content prompts, publishing preparation, and optional paid post boosts.

PresenceOS assists you with content creation and distribution. It does not guarantee audience growth, impressions, likes, comments, leads, revenue, employment, investment, customer acquisition, or any other business outcome.

Your account and responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it updated.

You are responsible for reviewing all posts, comments, images, and other outputs before publishing or using them. PresenceOS is built around user control. You decide what to publish, where to publish it, and when to publish it.

User content

You retain ownership of the content, ideas, prompts, voice inputs, profile information, drafts, posts, comments, images, and other materials that you submit to PresenceOS, subject to any rights you grant to third-party platforms when you publish content there.

You grant PresenceOS a limited license to host, process, reproduce, modify, display, and use your content as necessary to provide, maintain, secure, improve, and support the service. This includes using your inputs to generate drafts, images, recommendations, comments, and product experiences requested by you.

You represent that you have all rights needed to submit your content and that your content does not violate applicable law, third-party rights, platform rules, or these Terms.

AI-generated content

PresenceOS uses AI systems to help generate or improve text, images, recommendations, and other outputs. AI outputs may be inaccurate, incomplete, repetitive, similar to outputs generated for others, or unsuitable for your intended purpose.

You are responsible for checking AI outputs before using them. This includes checking factual claims, legal claims, professional claims, intellectual property issues, confidentiality issues, tone, accuracy, and compliance with the rules of LinkedIn or any other platform where you publish.

PresenceOS does not provide legal, financial, employment, medical, tax, investment, or other professional advice. Do not rely on AI outputs as professional advice.

AI image generation

If you use image generation features, you are responsible for ensuring that the images you use are appropriate, lawful, and suitable for publication. You must not generate or use images that infringe third-party rights, mislead viewers, impersonate people without authorization, or violate applicable law or platform policies.

Post boosts

PresenceOS may offer optional paid post-boost services intended to help increase reach through a network or manual distribution process. Boosts are not advertising inventory purchased from LinkedIn unless explicitly stated. Boost outcomes may vary.

Any estimates for reach, likes, comments, timing, or engagement are estimates only and are not guarantees. PresenceOS may reject, pause, or cancel a boost if the content is unlawful, misleading, unsafe, inappropriate, violates platform policies, or is otherwise unsuitable for amplification.

Subscriptions, billing, and refunds

PresenceOS may offer a paid subscription, including a monthly plan and an annual plan with a discount. Current marketing copy may describe a $20 monthly plan and a 10 percent annual discount. Final prices, currencies, taxes, trial offers, and billing terms may vary by region and platform.

If you subscribe through Apple, billing, cancellation, and refunds are handled by Apple according to Apple’s App Store terms and policies. You can manage or cancel your subscription through your Apple account settings. PresenceOS does not control Apple’s refund decisions.

For corporate or business plans purchased outside the App Store, payment, renewal, cancellation, and refund terms should be set out in the applicable order form, invoice, or separate agreement.

Acceptable use

You agree not to use PresenceOS to create, publish, boost, or distribute content that is unlawful, deceptive, defamatory, harassing, hateful, discriminatory, sexually exploitative, violent, infringing, spammy, or otherwise harmful.

You also agree not to reverse engineer the service, interfere with security features, access the service using unauthorized means, scrape or overload the service, misuse AI outputs, impersonate others, or use PresenceOS to violate the rules of LinkedIn or any other third-party platform.

Third-party services and platforms

PresenceOS may interact with or reference third-party services, including Apple, LinkedIn, analytics providers, AI infrastructure providers, payment processors, email tools, support tools, and hosting providers. Your use of third-party services is governed by their own terms and policies.

PresenceOS is not owned by, endorsed by, or affiliated with LinkedIn unless expressly stated. You are responsible for complying with LinkedIn’s terms and policies when posting, commenting, engaging, or boosting content related to LinkedIn.

Intellectual property

PresenceOS, including its software, design, branding, website, workflows, graphics, logos, and other materials, is owned by its operator or licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from PresenceOS except as allowed by these Terms or with written permission.

If you provide feedback, ideas, suggestions, or recommendations, you allow PresenceOS to use them without restriction or compensation.

Changes to the service

PresenceOS may add, remove, suspend, or change features at any time. This may include changes to pricing, subscription plans, AI features, boost features, availability, eligibility, or integrations.

Termination

You may stop using PresenceOS at any time. PresenceOS may suspend or terminate your access if you violate these Terms, create risk for the service or other users, fail to pay applicable fees, or use the service in a way that may cause harm or legal liability.

Disclaimers

PresenceOS is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, PresenceOS disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

Limitation of liability

To the maximum extent permitted by law, PresenceOS and its affiliates, officers, employees, agents, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, or loss of opportunities.

To the maximum extent permitted by law, the total liability of PresenceOS for any claim related to the service will not exceed the amount you paid to PresenceOS for the service in the three months before the event giving rise to the claim, or the minimum amount permitted by applicable law, whichever is greater.

Indemnity

You agree to defend, indemnify, and hold harmless PresenceOS and its affiliates from claims, damages, liabilities, losses, costs, and expenses arising from your use of the service, your content, your violation of these Terms, your violation of law, or your violation of third-party rights or platform policies.

Governing law and disputes

Unless a separate written agreement says otherwise, these Terms should be governed by the laws of India, without regard to conflict-of-law principles. Insert the correct exclusive court venue or arbitration mechanism before launch.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will show when the Terms were last revised. Your continued use of PresenceOS after changes become effective means you accept the updated Terms.
